Canadian Migration Law

Who gets in? How does Canada classify people as legal vs. non-legal, temporary vs. permanent residents, and immigrants vs. refugees? This course focuses on Canadian legislation, policy and practice regulating entry to Canada and Canadian residence. Canadian law and practice regarding refugee protection will also be covered. Given the endless debate regarding migration issues in Canadian society, students will be encouraged to explore popular conceptions and misconceptions about Canada’s migration laws and practices. Active class participation by students will be an expectation, which will include presentation reports from hearing observations, news reports, and cases. Observation of an immigration or refugee hearing and/or Federal Court judicial review application will also be required.
